Former Eastlake detective sentenced to 5 years in prison

Former Eastlake Police Detective Frank “Dak” Cochran apologized Thursday for receiving and distributing child pornography.

“I’ve made some serious improper decisions that hurt a lot of people and I take 100 percent responsibility,” Cochran said. “What bothers me most is that my actions further promote the exploitation of children. I know better. I shouldn’t be here.”

The 52-year-old Mentor resident was in U.S. District Court in Akron to ask Judge Sara Lioi to sentence him to the minimum five years in prison. He received the five-year sentence and was labeled a sex offender.

Lioi called Cochran’s conduct “egregious and illegal,” but granted his request based on the fact that the 19-year member of the police force was a well-respected part of the community prior to his crimes.

“He’s not the typical offender, if there is such a thing,” Lioi said. “The case is perplexing because Mr. Cochran, you led such an exemplary life for many years. You were even involved in investigations in child pornography. But there is no indication you acted out on any impulses.”

The 1994 “Eastlake Officer of the Year” faced up to 20 years in prison after pleading guilty in February to one count of distributing images of minors engaged in sexually explicit conduct.

When officials raided his home in 2007, there were between 10 and 100 images of pre-pubescent children.

Yet most of Cochran’s friends and family members never stopped standing by him.

Eleven people came to support Cochran on Thursday.

None of them spoke during the hearing, but many in attendance wrote letters on his behalf that the judge took into consideration. The letters revealed a far different person from the one who committed the offenses.

His wife, Theresa, said she was divorced with two very young children when she met Cochran at their job at TRW.

She began dating him after he never left her side during a family tragedy in which her 3-year-old nephew died after being hit by a car.

After they were married a year later, Cochran treated his wife’s children as his own and continues to be a positive force in their lives, defense attorney Jennifer Schwartz said.

Wendy Barcik, his stepdaughter, said she was estranged from her natural father for years but that Cochran was always there for her.

“My father was not there for me as a child or in my early adulthood years,” she wrote. “Frank was the one who taught me how to drive and then helped me buy my first car. Frank was the one who gave me the encouragement to go to college and pursue an area I am passionate about. Frank was the one who helped mend the relationship between my mother and me when we were not getting along. Without his guidance, things could have had a very different outcome for my brother and I.”

Megan Cochran, the former detective’s only natural child, also asked the judge for leniency, noting that his dedication also applied to his highly decorated career.

One of Cochran’s former neighbors told the judge she never noticed anything unusual about his interactions with children.

“Mr. Cochran does not engage in relationships with the neighborhood children,” wrote Kathleen Tagliamonte. “He doesn’t loiter where children congregate, position himself to observe children or put himself on display. He has not attempted to become chummy with neighbors to gain access to our children. I feel confident in asserting that Mr. Cochran’s behavior in our neighborhood and towards our children is utterly inconsistent with his pornography interest. I have never feared him, nor feared having him near our children.”

Assistant U.S. Attorney Michael Sullivan acknowledged that the mistakes Cochran made does not erase the overall life he lived.

“We don’t dispute the positive influence he’s had on others,” Sullivan said.

Cochran — dressed in an orange prison jumpsuit — said he still does not know why he became interested in child porn, and is hoping to find answers in the prison counseling program.

“I’m very lucky to have such a loving and supportive family,” he said before being led back behind bars. “I will work hard to regain your trust.”

Former detective pleads guilty to child porn charge

A former Eastlake police detective has been remanded to the custody of U.S. marshals after pleading guilty Wednesday to receiving and distributing child pornography.

Frank “Dak” Cochran Jr., 52, of Mentor, is being detained without bail.

He faces between 5 and 20 years in prison and a maximum $250,000 fine when he is sentenced April 24 by U.S. District Judge Sara Lioi in Akron.

Cochran’s home was raided by federal agents Nov. 9, 2007.

Agents found more than 10 and fewer than 150 images of “real, pre-pubescent minors engaged in sexually explicit conduct” on his computer, Assistant U.S. Attorney Michael Sullivan said.

The images were transmitted across state lines between Sept. 2, 2006, and Aug. 14, 2007.

“He sent and received e-mail images through the Internet to Georgia using America Online,” Sullivan said.

Cochran remained on paid administrative leave from the police department for more than a year until he resigned last month. His attorneys, Niki and Jennifer Schwartz, attempted to argue that Cochran be allowed to remain free because of the “extraordinary circumstances” of his job.

“We believe his safety would be in jeopardy if he would be confined in a local facility,” Jennifer Schwartz said.

Sullivan successfully argued that Cochran is facing mandatory prison time, making him a possible flight risk.

Cochran — a onetime “Eastlake Officer of the Year” — did not speak on his own behalf other than to politely answer routine questions.

Eastlake Police Chief John Ruth — who did not attend the hearing — declined comment afterward.

“I really have nothing further to say,” Ruth said.

Eastlake Mayor/Safety Director Ted Andrzejewski said the city took appropriate action against the veteran detective.

“I’m saddened by the crimes committed by Detective Cochran,” the mayor said. “But he is no longer a member of the police force, and his actions should not reflect on the entire city’s police department and all the work the men and women do to protect the city of Eastlake.”

Cochran previously signed a 14-page plea agreement between the U.S. Attorney’s Office and defense attorneys. But that agreement is not yet public record, and Lioi does not have to adopt it.

After he completes his prison sentence, the judge can order that Cochran be placed on supervised release for life. His attorneys could argue that sentencing guidelines be lowered.

“Consideration could be made for acceptance of responsibility,” the judge said.

Cochran has agreed to forfeit the laptop computer and other materials that were seized at his home.

The case was investigated by the Cleveland office of the Department of Homeland Security and Immigration and Customs Enforcement.

The charge stems from activity that occurred between Sept. 2, 2006 to Aug. 14, 2007, according to information released from the U.S. Department of Justice.

Cochran is accused of receiving and disseminating child pornography by computer.

Cochran’s Mentor home was raided by federal agents Nov. 9, 2007. Agents wearing U.S. Immigrations and Customs Enforcement hats removed boxes of potential evidence from the home. Cochran remained on paid administrative leave from the police department until he tendered his resignation earlier this month.

If convicted, Cochran would face between five and 20 years in prison and up to $250,000 in fines.

Judge Sara Lioi will preside over the case. The case is being prosecuted by U.S. Attorney Michael A. Sullivan and was investigated by the Cleveland office of the Department of Homeland Security and Immigration and Customs Enforcement.
